I will fight tirelessly to protect the liberty and property rights of every client accused of a crime. Our criminal justice system operates effectively only when the criminally accused have a zealous and skillful advocate for their defense. Regardless of what you are accused of, you will find in my office a "judgment-free zone" that will help achieve the best possible outcome for you. Although I am willing to handle every type of criminal case, the three most common types of cases are discussed briefly below.
* D.U.I. -- For many good, law-abiding people, their only contact with the criminal justice system is a charge of driving under the influence of alcohol or drugs. Their reactions range from fear and shame to indignance and defiance. In any case, a D.U.I. is not the end of the world, but this is a very important time in your life when you need to make good decisions to minimize future consequences. No matter what your own feelings about your charges may be, you will need the strongest possible defense to protect you against not only further time behind bars, but also against the long-lasting effects of a conviction on your insurance rates and on your "privilege" to drive. Some defendants make the mistake of attempting to represent themselves, but unless you went to law school, "one who represents one's self has a fool for a client." Other defendants make the mistake of hiring an attorney based on his or her years of experience, without recognizing that many defense lawyers are looking only to collect a fee and plead their clients guilty. I can't promise you any particular outcome, but I can promise you that I will give you a fair assessment of your chances in going to trial, and diligent and aggressive representation based on your choice of legal procedures.
* Drugs -- People use drugs because they work; unfortunately, some of them are illegal. Some attorneys may feel that you have committed a moral wrong that deserves punishment, but I am more interested in helping you move forward, getting treatment when needed, and minimizing the various long-term repurcussions of any convictions. Public opinion regarding drug prohibition has changed substantially in recent years; I am willing to take drug cases to trial in front of Bay Area juries who don't want to find themselves on the wrong side of history.
* Traffic Infractions -- Although every traffic infraction is technically a "crime," many lawyers refuse to take traffic cases because they can't charge a sufficiently large legal fee. I have never seen money as my primary motivation for practicing law. With that said, of course I have to make a living, and I have two primary advantages in being able to offer defense against traffic tickets: first, as a sole practitioner, my overhead costs are very low; second, because my office is located almost directly across the street from the Walnut Creek Traffic Court, the time required for representing you in these cases is less than most of my competitor colleagues. I am very famiiliar with the policies and procedures of our local traffic court, and in many cases there is the possiblity of a complete dismissal of your charges, saving you many dollars in the long run.
I believe that the rights guaranteed by the United States Constitution and the Constitution of the State of California must be safeguarded by vigorous assertion of those rights through our civil justice system. Where constitutional rights have knowingly been violated by persons acting under governmental authority, the law provides remedies, including substantial monetary damage awards in many cases. I will fight for full compensation for any violation of your legal rights. While there are constitutional rights too numerous to discuss here, some of the most common problem areas that could give rise to a lucrative cash settlement or award include: unreasonable and unlawful arrest or detention; unreasonable search and/or seizure of persons or property; malicious or discriminatory prosecution or treatment by civil authorities; and infringements on personal liberties guaranteed under the First Amendment, including rights to freedom of religion, speech, press, assembly, and petition.
